Aggressive DUI Defense
Aggravated DUI is an elevated DUI charge under Arizona law. It means that there were circumstances in your legal record dictating that the charges should be increased, along with the possible penalties you face.
The attorney you hire can make the difference in the outcome of your case
If you have two or more prior DUI convictions on your record within the past 60 months, prosecutors have the option of charging you with the serious felony of aggravated DUI. Under Arizona law, aggravated DUI is a class four felony that can result in a minimum four-month prison sentence.
You may also be charged with aggravated DUI if the prosecutor can prove that you were driving on a suspended or revoked driver's license. If you had a minor under the age of 15 in the car with you at the time of your arrest, you could also be charged with child abuse. Aggravated DUI accompanied by an endangerment charge will result in a mandatory 15 month prison sentence.
